How To Fill Out A Trademark Application

Filing a trademark application is quite easy. However, the online process of filing is more convenient. You can use the TEAS (Trademark Electronic Application System) after logging into the USPTO (United States Patent and Trademark Office) website. Application in paper forms is not quickly processed and costs 50 dollars or more.

A trademark refers to a symbol, name, or other means of product identification. It has official registration and restricted legally on the manufacturer or owners for use. This is necessary in preventing others to use the same or identical marks. A trademark is abbreviated as or TM.

The steps when filling an application online are very easy: first you need to find the USPTO site and log into it, then you should find “Trademarks” in the menu and choose the “FILE online” option. This process is free from ambiguity and can be done by anyone. You also have to write the exact date when you first used your mark, describe it, and make a presentation of your products or services which will be using that mark.

Also, don’t forget to choose a field for your mark. These are various classifications, but they have a help system so you shouldn’t worry about not finding the right field for you trademark.

Moreover, you must accompany your applications with: trademark drawings (word marks: simply encode the words; graphic marks: include graphic images or photo files); proposed mark samples of its usage; and online registration of 325 dollars per classification.

There are also qualifications to meet before your trademark can qualify for a federal registration. First, use your trademark as an “interstate commerce” to register with the USPTO. It means that your trademark is intended for services or products which crosses national, territorial, or state borders, or directly affects commerce which crosses in those lines. Take for instance; a motel, a restaurant, or an internet business which caters to international or interstate customers.

If your trademark is accepted by the USTPO you will find out from the “Official Gazette”, this process is making it a worthy of choice candidate for the federal registration. At this point, any owners of trademarks can object, if anyone does that they will start a preliminary examination where you can solve any dispute. However, if there are no objections to your trademark, you will receive a response in about one year but it can also last more than one year. The delay depends on any legal problems that may occur during the procedure.

If you want to keep the trademark’s legal character you have to file another document where you state that you will use your trademark. This is a very good way to obtain more rights. Also, you need to be aware of the fact that the USPTO has no responsibility to inform you about the statements. Also, the federal registration can be terminated if you don’t replace your statements. Before starting the registration process, ensure that you have understood all the legal conditions.

What is a Quality Manual for ISO 13485?

A quality manual is a high-level definition of a quality management system of your company. It is similar to an expanded mission or vision statement. Quality manual establishes the policy-level position of your management in the area of quality management system (QMS) and compliance with applicable regulations. There are two definitions of what a quality manual for an ISO 13485 QMS should be:

ISO 10013, Guidelines for Developing Quality Manuals, element 4.2, provides suggestions for creating a quality manual. It defines a quality manual, among other requirements, as a document that should “consist of, or refer to, the documented quality system procedures intended for planning and administration of activities which impact on quality” ISO 13485:2003, element 4.2.2 describes a quality manual as a document containing:

1 - the scope of the QMS

2 - justified exclusions or non-applicable clauses;

3 - references to the documented procedures;

4 - a description of interaction between the processes of the QMS

5 - definition of the QMS structure

Typically, companies state the scope of their QMS in the Scope or Introduction sections of their quality manuals, similar to “XYZ Corporation assembles, packages and distributes personal hygiene product packs to hospitals and doctors’ offices”

After we defined the scope and exclusions, let’s describe used processes and references to the corresponding procedures. As I found through my consulting and auditing work, the best way to start this step is to transform ISO 13485 standard from a set of applicable requirements into your company’s commitments to satisfy those requirements. For example: If element 7.1 requires that the company shall establish “?documented requirements for risk management?” our manual will state: “ABC Medical, Inc. has established and maintains documented procedure for risk management?. This process is documented in the Risk Analysis Procedure.”

As you can see, a reference to a specific procedure satisfies the third requirement for a quality manual (above). Following this approach by addressing all applicable elements of the standard and referencing corresponding procedures, we will establish a manual that meets the requirements of ISO 13485:2003 standard.

Now we need to choose a method to document interactions between our processes. There are a few ways to do it. One typical method is to utilize Figure 1 in ISO 9001:2000 standard. This figure shows a model of a process-based QMS. In addition to that, referenced documents will show what processes relate to those listed in our quality manual. Some models are available on the Internet. Enter “process interaction matrix” into the search field of your Explorer and you will find your answers.

The fifth requirement of the element 4.2.2 is to address the structure of the documentation. Many organizations I worked with defined their documentation structures as a 4- or 5-level structure in the documentation management section of the manual.

Now, when we addressed the requirements of ISO 13485:2003 standard for quality manual, consider this. A quality manual may become a strong marketing tool. It can tell your potential clients and vendors that your organization is not only a quality-conscious organization, but that it also realizes benefits of a well documented commitment to quality and compliance with regs.

It was always a mystery to me why some companies mark their quality manuals with a big red stamp “FOR INTERNAL USE ONLY”. Our clients are strongly encouraged to make their quality manuals public, assuming that your manual did not include any proprietary information.
